1. Acceptance of Terms

By accessing or using GrowOS ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

GrowOS is a smart mushroom farm management platform that provides environment monitoring, yield prediction, batch tracking, compliance reporting, and team management tools for commercial mushroom growers. The Service is provided on a subscription basis ("as a service").

3. User Accounts

When you create an account with GrowOS, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 18 years old to use the Service. By creating an account, you represent that you have the legal capacity to enter into these Terms.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Transmit malware, viruses, or harmful code
• Engage in unauthorized access to systems or data
• Use the Service for any unlawful or fraudulent purpose
• Interfere with or disrupt the integrity or performance of the Service
• Resell, sublicense, or commercially exploit the Service without authorization

5. Intellectual Property

The GrowOS platform, including its software, design, logos, and branding, is the intellectual property of GOLAAA. You may not copy, modify, distribute, or create derivative works of the Service without our explicit permission.

You retain ownership of your farm data, batch records, yield data, and other content you input into the Service. By using the Service, you grant us a limited license to host and process your data solely for the purpose of providing the Service to you.

6. Subscription and Payment

GrowOS is offered on a subscription basis with pricing tiers as posted on our website. By selecting a subscription plan, you agree to pay the fees associated with that plan. Fees are non-refundable except as required by applicable law or as explicitly stated in our refund policy.

We reserve the right to change pricing with reasonable notice. Price changes will not apply retroactively to your current billing period.

7. Third-Party Services

The Service may integrate with third-party hardware, sensors, and software. We are not responsible for the content, accuracy, availability, or privacy practices of third-party services. Your use of such services is at your own risk and subject to their respective terms.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any defects will be corrected. Use of the Service is at your own risk.

GrowOS is a farm management tool and does not replace professional agricultural judgment. Crop outcomes depend on many factors beyond software — we provide data and insights, but you are responsible for cultivation decisions.

9. Limitation of Liability

To the maximum extent permitted by law, GOLAAA and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, crops, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

You may cancel your account at any time through your account settings. We reserve the right to suspend or terminate your access to the Service at our discretion, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service will cease immediately. We will retain your farm data for 30 days after termination, during which you may request an export. After 30 days, we may delete your data.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will provide notice of material changes through the Service or via email to the address associated with your account. Your continued use of the Service after changes take effect constitutes your acceptance of the modified terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
